Maastricht University Professor Oswald Jansen Paid Visit to CESL

On the morning of May 7, 2015, Professor Oswald Jansen from Maastricht University, the Netherlands, paid a visit to the China-EU School of Law. Professor Jansen gave a lecture on ” Administrative sanctions between administrative law and criminal law: an European approach” in Room 306 of Mingfa Building, Changping Campus. The lecture was hosted by Dr. Clemens Richter, the European Co-dean of CESL.

Before the lecture formally started, Dr. Richter gave a warm welcome to Professor Oswald Jansen and briefly introduced the topic of the lecture. Professor Jansen started his lecture referring to the differences and inner links between administrative law and criminal law and then discussed the following parts: the definition of administrative sanction, the criminal and administrative law division, the general principles applied in the administrative sanction system, rights of defence in administrative sanctioning system, the organization of sanctioning power and other relevant powers, like investigation and inspection. In the latter part of the lecture, Professor Jansen briefly referred to the issue of judicial review of administrative sanctions in connection with Article 6 and Article 13 of European Convention of Human Rights and made a comparison between the review offered by administrative and criminal courts.

After the lecture, the CESL students raised their questions on how the administrative courts guarantee the justice of judicial review and under what circumstance would citizens benefit from the right of silence during inspections carried out by administrative authorities rofessor Jansen kindly and patiently answered the questions.
